Welcome to Flower Room LLC ("Flower Room," "we," "us," or "our"). By accessing or using our website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.

2. Products and Services

Flower Room provides fresh floral arrangements, bouquets, gift items, and related products. All products are subject to availability. We reserve the right to:

• Discontinue any product at any time without notice
• Limit quantities of products offered
• Substitute flowers of equal or greater value when specific varieties are unavailable (due to seasonality or supply)
• Refuse service to anyone for any reason

Flower Substitution Policy

Due to the perishable and seasonal nature of fresh flowers, exact flower varieties shown in product images may not always be available. In such cases, our florists will substitute flowers of equal or greater value, maintaining the overall style, color palette, and aesthetic of the arrangement. By placing an order, you acknowledge and accept this substitution policy.

3. Orders and Pricing

• All prices are displayed in US Dollars (USD) and are inclusive of applicable taxes unless otherwise stated.
• We reserve the right to change prices at any time without prior notice. The price at the time of your order is the price you will be charged.
• An order is not confirmed until you receive an order confirmation email from us.
• We reserve the right to cancel any order for any reason, including suspected fraud. If we cancel your order, you will receive a full refund.

4. Payment

We accept payment through our secure payment processor. By providing payment information, you represent that you are authorized to use the payment method. All payment information is processed securely and we do not store your full credit card details on our servers.

5. Delivery

Delivery Terms

• Delivery times are estimates and not guaranteed. We make every reasonable effort to deliver within the selected time window.
• Same-day delivery is available for orders placed before our daily cutoff time, subject to delivery zone availability.
• Delivery is available within our specified service areas only. Delivery fees vary by location.
• We are not responsible for delays caused by incorrect addresses, restricted access, weather, traffic, or other circumstances beyond our control.

Failed Deliveries

If delivery cannot be completed because no one is available to receive the order, we may:

• Leave the arrangement in a safe, shaded location at the delivery address
• Attempt redelivery at an additional charge
• Contact you to arrange an alternative delivery time or pickup

We are not responsible for the condition of arrangements left unattended at the recipient's request or when no one is available.

Pickup Orders

If you select in-store pickup, orders must be collected within the specified time window. Orders not collected within 24 hours of the scheduled pickup time may be forfeited without refund.

6. Cancellations and Refunds

• Cancellations: Orders may be cancelled for a full refund if the cancellation is made before the arrangement has been prepared. Once preparation has begun, cancellation may not be possible.
• Refunds: If you are unsatisfied with your order, please contact us within 24 hours of delivery. We will work with you to resolve the issue, which may include a replacement arrangement or a partial or full refund at our discretion.
• Perishable goods: Due to the perishable nature of flowers, we cannot accept returns. Refund eligibility is determined on a case-by-case basis with photographic evidence of any issues.

7. Gift Messages and Special Requests

We will make reasonable efforts to include gift messages and accommodate special requests. However, we reserve the right to decline requests that are inappropriate, offensive, or beyond our capabilities. Flower Room is not liable for errors in gift messages caused by typographical errors in the customer's submission.

8. User Accounts

When you create an account, you are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these terms or are used for fraudulent purposes.

9. Subscriptions and Recurring Orders

If you subscribe to a recurring flower delivery service:

• Your payment method will be charged automatically at the beginning of each delivery cycle
• You may cancel your subscription at any time before the next billing cycle
• Cancellation takes effect at the end of the current billing period
• We will notify you of any price changes to your subscription before the next billing cycle

10. Intellectual Property

All content on this website — including text, images, logos, floral designs, graphics, and software — is the property of Flower Room LLC and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without our express written permission.

11. Limitation of Liability

To the fullest extent permitted by law, Flower Room LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our website or services, including but not limited to:

• Damage or deterioration of perishable products after delivery
• Allergic reactions to flowers or plant materials
• Delays in delivery beyond our reasonable control
• Any loss or damage resulting from unauthorized access to your account

Our total liability for any claim shall not exceed the amount you paid for the specific order giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Flower Room LLC, its officers, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of our website or violation of these terms.

13. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts located in New York City, New York.
